These Terms of Service (“Terms”) govern your use of JoeyMate, a baby and family care tracking application operated by Grimstac (“we”, “us”, “our”), a business based in Victoria, Australia. By creating an account or using JoeyMate you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years of age to create an account. By registering, you represent and warrant that you are 18 or older. JoeyMate is intended for parents, guardians, and authorised carers tracking the care of infants and young children.

3. Children’s data and parental responsibility

You, as the account holder, are solely responsible for the child profile data you enter. You confirm that you have the legal authority (as a parent, guardian, or authorised carer) to record and share the child’s care information with invited co-carers. Do not enter data about a child if you do not have authority to do so.

5. Medical disclaimer

JoeyMate is a personal record-keeping tool only. It is not a medical device, is not a substitute for professional medical advice, and is not approved by the Therapeutic Goods Administration (TGA) or any regulatory authority. Nothing in the application constitutes medical advice. Always consult a qualified healthcare professional regarding your child’s health, development, or any medical concern. 6. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using JoeyMate you consent to the practices described in the Privacy Policy.

7. Intellectual property

All software, design, branding, and content comprising JoeyMate (excluding content you enter) is owned by or licensed to Grimstac. You are granted a limited, non-exclusive, non-transferable licence to use JoeyMate for personal, non-commercial family use only. You may not copy, modify, distribute, or create derivative works without our written consent.

8. Data and backups

While we take reasonable steps to protect your data, you are responsible for maintaining your own backups of important information. We are not liable for data loss resulting from service interruption, hardware failure, or user error. You may export your data at any time from Account → Export My Data.

9. Limitation of liability

To the maximum extent permitted by law, Grimstac’s total liability to you for any claim arising from or related to JoeyMate is limited to AUD $100. We are not liable for indirect, incidental, special, or consequential loss, including loss of data, loss of profits, or personal injury.

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the service or refunding the cost of the service.

10. Service availability

We do not guarantee that JoeyMate will be available at all times. We may suspend or discontinue the service with reasonable notice where practicable. We are not liable for any loss or inconvenience caused by downtime or service changes.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will notify you via the email address on your account or via an in-app notice at least 14 days before the change takes effect. Your continued use of JoeyMate after the effective date constitutes acceptance of the updated Terms.

12. Termination

You may close your account at any time from Account → Delete Account. We may terminate your access if you breach these Terms, after giving reasonable notice where possible. On termination, your data is deleted in accordance with our Privacy Policy.

13. Governing law and dispute resolution

These Terms are governed by the laws of Victoria, Australia. You and Grimstac submit to the exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia. Before commencing formal proceedings, you agree to notify us in writing and allow 30 days to attempt resolution in good faith.
